What to do if you are involved in a bicycle crash
You or a loved one has just been in a bicycle accident. Before you leave the scene of the crash, it is important that someone documents and gathers important information that can help your post-accident investigation. Here are some important things to do at the scene and once you are home.
- Remain calm and check yourself for injury before standing up.
- Move out of the way from oncoming cars. You may need assistance.
- If there is a serious collision, call 911 for police or medical assistance.
- Get the make, model, and license plate of the car, especially if the driver refuses to stay on the scene.
- Get the driver’s phone number, drivers license, address, insurance company and policy number, and vehicle registration information, if the driver remains on the scene.
- Gather witnesses’ names and contact information.
- Take photos of the crash scene, road conditions, vehicle, bike, and your injuries
- When you talk to a police officer, tell your recollection of events leading to the accident and what happened to you. When you are capable, write down all of the details of the accident, so that you have written notes of the accident for any future litigation.
- File a police traffic crash report and ask for its case number. Get a business card for the police officer’s contact information too.
- Keep your damaged bike, helmet or clothing intact, until you have had the chance to talk to any insurance company or lawyer. If you have any GPS tracking data on apps, such as Strava, keep a copy of that route as well for potential proof. Your documentation should also include photos of your damaged bike, your clothing, helmet or injuries on your body.
- Seek medical care, even if your injuries seem minor. It could take time before some injuries present themselves. The injuries can cause pain and discomfort that does not resolve quickly. It is better to have such injuries examined in case you need further treatment or compensation in the future.
- Refrain from posting about your injuries on social media. Insurance companies might use whatever you write online against you.
- Consider speaking to an attorney before you accept a settlement with an insurance company.
